UK CHILD ABUSE
COMPENSATION CLAIMS ADVICE
If you need to make a claim for child abuse compensation, we can help. An application can be made several ways, including an application to the Criminal Injuries Compensation Authority (CICA) or the abuser can then be sued personally in the civil courts in addition to being prosecuted in the Crown Court for criminal activity. Local Authorities and other employers may also be held to be liable to pay damages if they have failed to act reasonably either in their pre-employment checks or by failing to adequately respond to complaints from those corrupted or adult with reasonable suspicions. In addition, there are a number of groups where victims in the same situation at a particular locality, usually a children’s home, have joined together to take multi-party action. A multi-party claim also known as group action or class action can have the benefit of being publicly funded through Legal Aid and in any event is much cheaper to run privately as all victims who join the scheme share the potential cost, which may be financed by lawyers through no win no fee arrangements.
This problem occurs in many forms and has resulted in numerous applications to the CICA and to the courts. It can come in the form of physical, sexual, emotional, or psychological abuse caused by neglect, a lack of restraint, or failure to provide necessary services and treatment. Child abuse compensation can be claimed whether it was a one-on-one, family, or institutionalized abuse. The mentally disabled, elderly, and young children are the most vulnerable to abuse. Residential care homes, respite and day care organization, and schools are often magnets for pedophiles. However, child abuse is not confined only to these places and frequently occurs in the child’s home at the hands of their parents or other relatives.
Significant numbers of adults have come forward to the police and solicitors over recent years resulting in criminal convictions and custodial sentences giving rise to subsequent claims for compensation. In order to have a successful compensation claim with CICA, a conviction is not necessary, as long as the applicant cooperates completely with the investigating authorities.
